RULES & REGULATIONS

1.      The tenant shall be considered an occupant of the premises on a month to month basis only.  Rents are due and payable in advance to Shearer Investments LLC. / Ryan C. Shearer P.O. BOX 7215 Akron, OH 44306 without any deductions whatsoever!  The tenant will be charged with rent and care until the keys are returned to Shearer Investments LLC .

2.      Tenant shall make arrangements at his or her own expense for all public utilities, including gas, water, and electric, and shall pay for said utilities in addition to the rental herein provided.

3.      Tenant has examined and knows the condition of said premises and has received the same good order and repair and will surrender possession of said premises in as good order and repair and will surrender possession of said premises in as good condition as reasonable and careful use will permit.

4.      Dogs, Cats or other animals shall not be kept as pets, or shall they be kept on the premises.

5.      The premises are to be used as a private residence only.

6. Emergency Access. Landlord has the right of emergency access to the leased premises at any time and access during reasonable hours to inspect the property or, at reasonable times, to show property to a prospective tenant.  This clause shall not be construed to require the owner to perform any service.

7.      The owner shall not be liable at any time for any damages to any property on said premises or in said building from water, rain, or snow which may leak into, issue or fall from said building, of which the premises or hereby rented are a part, from the pipes, plumbing, roof or other leaks which may cause damage to the building.

8.      The tenant will be charged for damage to appliances, plumbing, sewage stoppage or broken glass caused by carelessness.

9.      No painting or alterations shall be made without written consent of the owner or agent.

10.              In addition to paying the first month's rent the tenant is hereby depositing the sum of  $____________ as a security for the performance of the obligations undertaken by the tenant and upon vacation of the premises the owner shall return the same without interest less any claims he may have against the same.  Said deposit shall in no way be applied upon rent.

11.              The tenant shall forfeit the deposit stated in term #10 if he or she should fail to occupy said premises for 3 days, and if any term in agreement is not fulfilled.

12.              The tenant shall give (30) days written notice of moving prior to the date of vacating the premises.

13.              The tenant further agrees to pay a late charge of $50.00 if the entire rent is not received by the Landlord by the 5 th day of the month regardless of the cause, including dishonored checks, time being of the essence. If rent is not paid by the 5 th day of each month, a 3 day notice to vacate will be issued for which $125.00 will be charged to the resident. All funds received shall be applied to: dishonored check charges; late charges; damage charges; delinquent rent; current rent; in that order. If an eviction is filed and or there is an agreed entry put in place, there will be an additional $366.00 charge to cover the legal fees.

TENANT RESPONSIBILITIES
A. SECTION 5321.05 – TENANT RESPONSIBILITIES

This section of the law covers the obligations of all who are tenants of rental property. A tenant is anyone who under a rental agreement (oral or written) is entitled to use and occupy property to the exclusion of others.

This section states that all tenants are required to:

•  Keep his apartment, house, or room in a safe and clean condition.

•  Dispose of all trash and garbage in a safe and sanitary manner.

•  Keep all plumbing fixtures in a clean condition.

•  Use all electrical and plumbing fixtures properly.

•  Comply with all health, housing, and safety codes.

•  Personally refrain, and forbid any guests or friends from intentionally or negligently destroying, defacing, damaging, or removing any fixture, appliance, or other part of the apartment, house, etc.

•  Maintain in good working order and condition, all appliances, including stove, refrigerator, etc.

•  Conduct himself and require other persons on the premises with his consent to conduct themselves in a manner which will not disturb their neighbor's peaceful enjoyment of the premises.

•  Not to unreasonably withhold the right of the landlord to enter the property to inspect the property, make repairs, decorate, etc.
